Before using this application (hereinafter the Service or application), it is important that you read and accept the following terms and privacy policy. These terms govern the relationship between CÁDIZ CENTRO COMERCIAL ABIERTO (hereinafter the Operator) and the users of the mobile application (hereinafter the USER).
These Terms of Use constitute a legally binding contract. If the user does not accept these Terms of Use, they will not be able to access and use the Service. The User must be aware that the Operator may offer services that are not subject to these Terms of Use but to its own terms and conditions. Access to the service
By using the application, the USER declares that they are over 14 years old and that, in any case, they are fully capable under their personal law to access this service and to accept these conditions in full effect.
The user can perform most of the functions offered by the application; however, in some cases, it will be necessary for the user to register by verifying their email account in order to fully utilize the functionality enabled by the mobile application.
The Operator may terminate or cancel the USER's account in the event of non-compliance with the obligations set forth in these conditions, without prior notice.
Information about the service
How can I use the Service of this application?
- To use this service, you must complete a first registration form.
- To validate your account, a confirmation link will be sent to the email address you provided during registration.
- You can also use your Facebook credentials to use the application; in the event that you choose this option, we inform you that the operator stores the basic data that you have given permission for in the application on Facebook, personal data associated with your Facebook profile, and that we do not have access to your Facebook passwords.
Why is geolocation information collected?
The essential purpose of processing positioning information is to obtain specific information about the most visited areas and points of interest and about their visitors in general. In addition, you will be able to benefit from promotions or offers that the Operator has prepared for users of this application.
In short, we do this to improve your shopping experience by analyzing how you use the Service to improve it and to be able to offer you a better way to communicate with you, and, if we have previously obtained your consent, combine your personal data, collected from your use of our various channels, such as the website, to provide you with information tailored to your needs and promotional material.
Your personal data will only be used to send promotional material if you have previously given your consent in each of the channels. Therefore, after registering on any of the channels where personal data is collected, you will be offered the opportunity to give your consent to the use of your personal data, in order to send you promotional materials; measure, test and monitor the measurements and the effectiveness of our service and ensure that everything is working properly and that we can protect you against any attempt at theft, loss, damage or unauthorized use and thereby comply with the legal obligations that apply to us.
On the other hand, you may receive commercial information from third parties; you should be aware that in no case have those third parties had access to the data related to your email address.
Who has access to my information?
Shared use with third parties chosen by the user
Common use with social networks. If you choose to access the application through your social media account or click on one of the connection buttons or links from the social networks (for example, the “Like” button from Facebook) that are available in the application, its content and your personal data will be shared with the corresponding social networks. You are informed and understand that this information may be published on your social network within your account.
You understand and accept that the use of your personal data, including the information you share with social networks through the Service, by the social networks is governed by their respective privacy policies. If you do not want the social networks to collect information about you, we advise you to review the privacy policies of the corresponding social network applicable to this matter, and either, close the session on the corresponding social network before using our service.
Responsibilities of the operator
The service provided by the Operator through this application is for informational purposes only. Although all reasonable measures have been taken to ensure that the Application’s Contents are current, accurate, complete, and up-to-date, the functionalities are provided on an “as-available” basis, without any guarantee whatsoever. The user expressly agrees that the use of this application by him/her is at his/her sole risk and discretion.
To the fullest extent permitted by applicable legal order, The Operator shall not be liable (i) for damages, losses or any consequence arising from any use of the Service or its Contents, or from User Content disseminated by the User on the Service, and (ii) to the User, in relation to indirect losses or damages, as well as for moral damages, loss of profit, loss of income, use or data derived from the use or operation of the Service. The User expressly acknowledges that (i) the Service is not free from errors or viruses, (ii) the connection to the Service involves the inherent risks of any connection and transmission over the Internet and mobile telephone networks, in particular, with respect to the transfer speed, response time to queries or requests for information, and technical performance, (iii) the Operator has no control over third-party networks or websites to which the User may access in the course of using the Service. (iv) The Operator assumes no responsibility for the loss of any data, the impossibility of storing, the error in the delivery or untimely delivery of any data or material through the Service, and (v) the Operator disclaims all warranties, express or implied, including warranties of satisfactory quality or merchantable fitness, or of suitability for a purpose or need, with respect to the Content and the Service.

Protection of personal data
For the purposes of compliance with Regulation EU 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (GDPR), you are informed that the data that you provide to us in the registration process or subsequently using the application will be included in the activity register of the processing owned by EL OPERADOR, whose purposes will be the management and maintenance of the Service offered by this application as well as the different data processing procedures indicated in this privacy policy.
In compliance with the principle of transparency contained in Article 12 of the GDPR, we inform you concisely about the purposes for which we will use the following data that you provide to us:
- We use your email to associate it with your user account, as well as to send you commercial communications, provided that you have expressly authorized us to receive them.
- We use your name and surname to send you personalized non-commercial messages.
- The date of birth, in addition to verifying that you are of legal age to use this application, is used to make various recommendations based on your age.
- The family situation and gender are used to make various recommendations based on your age.
- Phone number. If you provide us with your phone number, we can use it to contact you via SMS or by phone to inform you about offers of interest.
- We will only ask for your DNI number if you use the children's library service, and only for the purpose of identifying you at the children's library.
- Your address, if you provide it to us, will be used to send you commercial communications if you consent to this, as well as to make recommendations based on your geographic area.
- Your geographic location (for example, acquired via GPS) is used, if you consent, to be able to carry out segmented commercial communications, as well as to detect if you are near one of our points of sale or points of interest. If we detect that you are within a point of sale or point of interest, we will track you within that point of sale in order to be able to offer you personalized offers based on your location. The location is also necessary to be able to redeem coupons or other types of promotional offers.
In addition, we can see how you use the application and, based on that, customize content that we consider of interest to you.
The legal basis for all the treatments described above is consent; we will keep the necessary information to prove that you have given the appropriate consent. You can withdraw the consent you gave previously at any time.
There are no categories of recipients planned, nor are there any international data transfers, except for the data controller for the sole purpose of hosting the information provided, which is specifically the company DIGITAL OCEAN on its servers in Amsterdam, the Netherlands VAT EU528002224.
We also inform you that you have the rights of access, rectification, opposition, deletion and limitation of the processing of your personal data, which you can exercise by writing to the address of the OPERATOR. The information we obtain from you will be kept confidential while you use the application; if you unsubscribe, we will delete your profile and keep your personal data for a period of 3 years to be able to respond to any responsibilities arising from the processing of your personal data. You can find further information about the rights recognized in the data protection regulations below.
We also inform you of the possibility of filing a complaint with the Spanish Data Protection Agency if you believe that the processing of your data is not being carried out properly.

Some of the data that we request from you in the registration form is mandatory; without these mandatory data, we will not be able to provide you with the Operator Service.
The personal data we collect will be treated confidentially, applying the technical and organizational measures established in our internal security policy; we also inform you that a risk analysis and an impact assessment have been carried out to ensure that we protect the information of our users in order to prevent its improper access, manipulation or deletion, without, except with the express consent of the USER, being transferred to other entities or third parties outside the legally permitted cases and with the exception of the publication of the USER's name in the user rankings.

- You contest the accuracy of the personal data, for a period that allows us to verify its accuracy.
- The processing is unlawful and you object to the deletion of the personal data and instead request the restriction of its use.

- You have objected to the processing on grounds related to your particular situation, while verifying whether the legitimate reasons as the controller of the processing prevail over those of the data subject.
